Terms of Service

1. Acceptance of Terms

By accessing or using SaaSGadget ("the Service"), operated by WxZRD Media ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Service.

2. Description of Service

SaaSGadget provides automated SaaS repository analysis, audit report generation, and project scaffolding tools via a CLI, MCP server, and web application. The Service analyzes code repositories you authorize and produces structured reports.

3. Account & Authentication

  • You must authenticate via GitHub OAuth to use the Service.
  • You are responsible for all activity under your account.
  • You must not share your session or allow unauthorized access.
  • We may suspend or terminate accounts that violate these terms.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Scan repositories you do not own or have explicit authorization to analyze.
  • Attempt to extract, scrape, or harvest data from third-party repositories beyond the scope of your authorized analysis.
  • Circumvent rate limits, token budgets, or tier restrictions.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to develop a competing product or service.
  • Transmit malicious code, exploit vulnerabilities, or disrupt the Service.
  • Violate any applicable law, regulation, or third-party rights.

Violation of this policy may result in immediate account suspension or termination without refund.

5. Subscription & Billing

  • Free tier users are subject to token budget limits and feature restrictions.
  • Paid subscriptions are billed monthly through Stripe.
  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • No pro-rata refunds are provided for partial months.
  • Consumed scan credits and report packs are non-refundable.
  • We reserve the right to modify pricing with 30 days' notice.

6. Cancellation & Refunds

  • You can cancel your subscription at any time via Account Settings.
  • Upon cancellation, you retain access until the end of your billing period.
  • After your billing period ends, your account reverts to the free tier.
  • We do not issue refunds for subscription fees already charged.
  • If you believe a charge was made in error, contact us within 30 days.

7. Intellectual Property

  • The Service, including its code, design, and documentation, is the property of WxZRD Media and is protected by intellectual property laws.
  • You retain all rights to your source code and repositories. We do not claim ownership of code you submit for analysis.
  • Reports generated by the Service are derivative analytical outputs. You may use, share, and distribute your reports freely.
  • The Service uses AI models to generate analysis. AI-generated content is provided as-is and should be verified before acting upon it.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ANALYSIS OR REPORT GENERATED BY THE SERVICE.

IN NO EVENT SHALL WXZRD MEDIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless WxZRD Media from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

10. Modifications

We may update these Terms of Service at any time. Material changes will be communicated via the application or email. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

12. DMCA & Copyright

We respect the intellectual property rights of others. If you believe that content generated by or accessible through the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent:

Your notice must include:

  1. Identification of the copyrighted work claimed to be infringed.
  2. Identification of the material to be removed, with sufficient information to locate it.
  3. Your contact information (name, address, phone, email).
  4. A statement that you have a good faith belief that the use is not authorized.
  5. A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act. Repeated infringers may have their accounts terminated.

13. Minimum Age

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information promptly.
